Sidewalk sheds are temporary constructs designed to protect people or goods from the elements. When erecting a structure that is more than 40 feet tall, dismantling a structure that is more than 25 feet tall, or when hazard warrants this form of protection, property owners must install a shed.

Once the building, demolition, or cleanup work is completed, sidewalk shelters must be removed promptly.

Approvals and Permits

Sidewalk shelters are not permitted to be erected without prior consent and work permits from the department. Owners may, however, erect a shed and file a permit application within 24 hours if there is an imminent threat to their safety.
Before the Department of Buildings authorizes the work permit, other City authorities may need to approve the shed.

For example, the NYC Department of Transportation’s Office of Construction Mitigation and Coordination needs a Building Operation Permit for sidewalk shelters that must extend into the roadway.

Width:

5-foot minimum and suitable for foot traffic Passageway Height: 8-foot minimum clearance at buildings higher than 100 feet Length: Along property line and 20 feet into adjacent properties for structures higher than 100 feet

Deck Storage:

Storing materials on top of a shed is potentially unlawful and not recommended.

Lighting:

Natural or artificial light must be used to illuminate the passageway at all times.

Egress:

Fire exits are not permitted to be obstructed.

DOT Street Signs:

Pedestrians and cars should be able to see DOT street signs.

Shed Deck Strength:

300 pounds per square foot minimum (150 pounds per square foot for sheds without storage and buildings less than 100 feet high)

Loading Areas:

Keep all loading areas (at deck or street level) covered, blocked, shuttered, or guarded at all times.
